Terms of service

These terms apply whenever you place an order with Pashtun Palace through this website. Placing an order means you accept them. If there is anything here you are not comfortable with, please talk to us before ordering rather than after.

1. Who we are

Pashtun Palace is a home-based Afghan food and catering business operating in Seattle, Washington, United States. Our contact details are on the contact page.

2. Orders and acceptance

Submitting an order through this site is an offer to buy, not a completed contract. Your order is accepted only when we send you a confirmation, and we may decline an order — for example if we are fully booked for that date, if the delivery address is outside our area, or if we cannot source an ingredient. If we decline after you have paid, you get a full refund.

3. Prices, taxes and fees

Prices are in US dollars and are shown before tax. Washington State retail sales tax is calculated at checkout at the rate configured for our location and is shown as a separate line. Delivery fees and, for catering, any service fee are also shown separately before you pay. We may change menu prices at any time, but never after your order is confirmed.

4. Lead times

Everything is cooked to order. To-go items need at least 24 hours’ notice, large trays 48 hours, and catering at least 3 days — usually much more for weddings and large events. The checkout will not offer you a slot that we cannot cook for.

5. Payment

We accept card payments through our payment processor, and depending on how the site is configured, PayPal, bank transfer, and cash on collection or delivery.

• Card and PayPal: taken at the time you order.
• Bank transfer: your slot is held for a short number of days, shown on your order page, while the money arrives. If it does not arrive within that window we may release the slot.
• Cash: available up to a limit shown at checkout, for collection and delivery only, never for catering. Please have the exact amount.
• Catering: a deposit — by default 30% of the quoted total — is required to hold your event date. The balance is due before the event unless we have agreed otherwise in writing.

6. Cancellations, changes and refunds

• To-go orders: cancel or change free of charge up to 24 hours before your slot. After that the ingredients are bought and the cooking has begun, so we cannot refund the order.
• Large trays and platters: 48 hours’ notice.
• Catering: cancel more than 14 days before the event and the deposit is refunded in full. Between 14 and 7 days, the deposit is retained. Inside 7 days, the full quoted amount is due, because the food has been bought and the date has been turned away from other customers.
• If we cancel for any reason, you receive a full refund of everything you have paid.

Refunds go back to the original payment method and typically take five to ten business days to appear, depending on your bank.

7. Collection and delivery

Please collect within your chosen window; food left beyond it may not be safe to serve and cannot be refunded. For delivery, someone must be available to receive the order at the address and phone number you gave us. If nobody is there and we cannot reach you, the driver will wait a short time and then leave; the order is treated as delivered and is not refundable. Delivery times are estimates given in good faith — traffic, weather and kitchen conditions can move them.

8. Food safety and allergens

Allergen notice. Our food is prepared in a kitchen that handles wheat, dairy, eggs, tree nuts (including walnuts), sesame and soy. We list the ingredients we know of for every dish and we will do our honest best to accommodate an allergy you tell us about in advance, but we cannot guarantee that any item is free from traces of any allergen, and we cannot offer a certified allergen-free environment. If you have a severe or life-threatening allergy, please take that limitation seriously when deciding whether to order.

Ingredient lists on this site are provided for information and may change without notice as recipes and suppliers change. If an allergen matters to you, ask us before you order, every time.

All of our meat is halal. No alcohol is used in any recipe.

Chilled and frozen items must be refrigerated or frozen within two hours of collection or delivery. Cooked food should be eaten the same day or refrigerated promptly and eaten within two days. Once food has left our hands, storage and reheating are your responsibility.

9. Photographs and descriptions

Photographs are of our own food, but portions, garnishes and colour vary between batches because everything is made by hand. Serving sizes such as “serves 2” are honest guidance, not a guarantee for every appetite.

10. Accounts

If you create an account, keep your password to yourself and tell us promptly if you think someone else has it. You are responsible for orders placed from your account. We may suspend an account that is being used fraudulently or abusively.

11. Our liability

Nothing in these terms limits our liability for death or personal injury caused by our negligence, or for fraud — nor could it. Subject to that, our total liability arising from any order is limited to the amount you paid for that order. We are not liable for indirect or consequential losses, such as the cost of an event that did not go the way you hoped.

12. Events outside our control

We are not liable for failing to perform where the cause is genuinely outside our control — severe weather, power or utility failure, illness in a one-person kitchen, road closures, or a supplier failure we could not have foreseen. We will contact you as soon as we know, and we will refund you in full if we cannot deliver.

13. Intellectual property

The text, photographs, recipes and design on this site belong to Pashtun Palace. Please do not republish them commercially without asking. You are very welcome to share links and to post your own photographs of our food.

14. Governing law

These terms are governed by the laws of the State of Washington, United States, and the courts of King County, Washington have jurisdiction over any dispute. Before going to court, please contact us — nearly everything is fixable with a phone call.

15. Changes to these terms

We may update these terms. The version that applies to your order is the one published when you placed it.
